CPC for toy weapons and blasters

Toy weapons stack three rule layers: the toy safety standard (16 CFR Part 1252 / ASTM F963-23) with its projectile provisions, separate federal imitation-firearm marking requirements for realistic-looking guns (the blaze-orange plug rule under 15 U.S.C. 5001), and choking-hazard labeling for the projectiles themselves. The CPC cites the toy rules; the marking and projectile rules come from their own statutes.

The three rule layers

  • Toy standard: projectile toys have kinetic energy and tip-radius provisions so darts cannot cause eye injuries.
  • Imitation firearm marking: realistic-looking guns require a blaze-orange plug or marking under federal law, with limited exemptions for preview models and some collectibles.
  • Choking hazard labeling: darts, pellets, and small projectiles on toys for older children carry mandatory warning language.

Design notes that prevent failures

Projectile energy is the classic failure point: darts with hard tips or excess kinetic energy fail the toy standard provisions. Soft tips, energy limits, and a shooting range documented in the report keep the product certifiable. And keep the orange marking present on anything whose silhouette could be read as a firearm by a stranger at ten meters.

Questions people ask

Does a water blaster need a CPC?

If it is a children’s product subject to the toy standard, yes: it is certified like any toy, and the projectile provisions apply if it shoots anything.

Do the orange plug rules apply to clearly colorful fantasy blasters?

The imitation-firearm marking law targets realistic-looking imitations; brightly colored fantasy designs are generally outside it. When the line is unclear, the safe default is the marking.

My darts passed but the packaging has no warnings. Is that OK?

No: projectile toys carry mandatory choking-hazard and usage warnings on the packaging. Missing warnings are a labeling violation on their own.
