Small parts testing: 16 CFR Part 1501
How the test works
The lab places each detachable part (and parts that detach after use-and-abuse testing: dropping, torque, tension) into the cylinder. If it fits completely, it is a small part. The rule applies to toys and articles intended for children under three, precisely the age when everything goes in the mouth.
What this means for your product and certificate
- Products for under-3s must pass small parts testing before any CPC is issued citing 16 CFR Part 1501.
- Toys for older children that contain small parts require the choking hazard warning labeling under separate labeling rules, and marketplaces often ask for it anyway.
- Your CPC lists the rule when applicable; the free generator includes 16 CFR 1501 in the under-3 preset.
Questions people ask
My toy is for ages 3+. Do I still need small parts testing?
The 1501 ban targets under-3 products, but testing for the toy standard (ASTM F963) includes small parts provisions by age grading. Follow your lab’s test plan for the claimed age grade.
Can I just add a “not for children under 3” label instead?
Only products legitimately for ages 3 and older can rely on labeling. If the product is intended for under-3s, labeling does not cure a small parts failure.
Do magnets have their own rules?
Yes: high-powered magnet sets have a separate standard, and ASTM F963 includes magnet access provisions. Discuss magnets explicitly with your lab.
